ORDER

 

1-Whereas, there ismushrooming of BPOs ( Business Process Outsourcing Centres)  prominently known as Call Centers, Corporateand Media houses, companies, organization and firms  in Delhi and other parts of the NCR offeringemployment opportunity for  the youths.

2- And whereas, theemployees including young woman from across the country have been staying invarious parts of Delhi while their work place may be in the NCR region andtheir employers are providing cab services for the purpose of picking up anddropping them from thier place of stay to office and back .As theseorganizations are functioning round- the- clock, the cabs are ferryingemployees even at late night hours. Such employers are reported to have hiredcabs on contract basis and have not been able to properly monitor these caboperators and their drivers for ensuring safe and secure transportation of theemployees resulting in grave danger to human life, safety and security of theemployees, especially of women employees.

3- And whereas, it has cometo notice that certain criminal and antisocial elements look for soft targets ,particularly during the odd hours and the women employees who travel duringlate night hours are vulnerable to crime and criminal acts by such elements, ifthey are not dropped securely and safely at their places of stay.

4- And whereas it isrendered imperative to put some regulatory check on organizations having suchservice picking and dropping their employees and the transporters, securityagencies, drivers and security guards involved in the same so that antisocialand criminal elements may not cause danger to human life and safety and theirproperty and it is felt that immediate action is necessary in this regard.

5- Now , therefore, in exerciseof the power conferred  up on me by  virtue of  Sec. 144 Cr.P.C., 1973 ( No-2 of  1974) read with Govt. of India , Ministry ofHome Affairs, New Delhi’s Notification No U-11036 /(i) UTL Dt 9-9-2010, I,  DATA RAM, Assistant Commissioner of Police, Sub-divisionKamla Market do hereby make this written order that all such organizationslike BPO’s , Corporate & Media Houses having the system of picking up anddropping their employees and the concerned transporters, security agencies,drivers and security guards in the jurisdiction of Sub Division Kamla Market,Delhi shall :

a)     Maintaina data base of all employees, security personnel, cab drivers and contractualworkers working with them, for access by the police as and when required.

b)     Hire thesecurity personal and other contractual personal as far as possible fromlicensed agencies only.

c)      Ensureverification of antecedents of all their employees including contractualemployees.

d)     Ensurethat women employees are not made to travel alone with the cab driver and a dulyverified security guard or a male Colleague (regular employee of the company isinvariably deployed in each cab carrying women staff during the night hours i.e08 PM to 07 AM.

e)     Choosethe route in such manner that as far as possible a women employee is not thefirst one to be picked up or the last to be dropped.

f)      Ensurethat during the night hours  the cabinvolved in transportation of women employees pick ups and drops such employeesright at their houses, remains halted at the point where a women employee hasbeen dropped till she confirms about her arrival / reaching at their residence/ place of stay through a telephone calls.

g)     Ensurethat, whenever the house of a women employee is so located that the approachroad is not motorable, the duly verified security guard or a male colleagueduring the night hours accompanies the employee on foot up to her house andtakes a confirmation about her safe arrival.

h)     Exerciseeffective check and control on the vehicle movement in order to check anyunwarranted activities of the cab drivers, such as picking up strangers,straying away from the designated route etc.

i)        Get GPS system installed in the cabs used inthe transportation of such employees, especially women employees.

6- These order shall comeinto force with effect from 29.05.2015, and shall remain in force for aperiod of 60 days up to 27.07.2015 (both days inclusive) unless with drawn earlier.

7- Any person/ employer/Transportercontravening this order shall be liable to be punished in accordance with theprovision of Sec 188 of IPC, and

8- As the notice cannot beserved individually on all concerned, the order is hereby passed ex-parte. Itshall be published for the information of the public through the press and byaffixing copies on the notice board of the offices of all DCsP, Add. 2. And whereas, it isnecessary to take speedy measures in this regard for the preservation of publicpeace and public safety.

3. Now, therefore I, DATA RAM, Assistant Commissioner ofPolice, Sub-Division Kamla Market, Central Distt.  NewDelhi, inexercise of the powers conferred upon me by virtue of Section 144 CriminalProcedure Code, 1973 read with Govt. Of India, Ministry of Home Affairs, NewDelhi’s Notification No. F. No. 11036/1/2010-UTL dated 09.09.2010 do herebyprohibit any person, not being a person in service or employee of the Govt.required by his superiors or by the nature of his duties to carry weapons orunless exempted by me or any other authorized by me in this behalf:-

(i)From carrying of fire –arms (including licensed fire arms). Cudgels, swords,spears, bludgeons, knives sticks or lathis including flag staff (excluding those less than 75 cm in length and 2 cmthick) or any other article which is capable of being               used for causing physical violence ;

(ii)From carrying of any corrosive substance or explosive;

(iii) From carrying, collecting or indulging in the preparationof stones or other                 missilesor instruments or other means of casting or impelling missiles ;

 

In any public place withinthe limits of sub-div Kamla Market, Delhi.

Any person professing,believing or following the Sikh faith may carry or posses with him a Kirpan.

4.  This order shall come into force witheffect from 29.05.2015and shall remain in force for a period of 60 days up to 27.07.2015 (bothdays inclusive) unless withdrawn earlier.

5.Any personcontravening this order shall attract punishment under clause (a) of subsection (2) of section 113 of the Delhi Police Act -1978 (34 of 1978) whichprovides punishment or imprisonment for a term which shall not be less thanfour months but which may extend to one year and shall also be liable to fine.

6.As this ordercannot be served individually on all concerned, the order is hereby passedEx-Parte.             Whereasa number  of banking and financial/business establishments like Banks/ ATMs, Private locker companies, jewelleryshops, petrol pumps, malls/ restaurants/ hotels, cinema halls/ cine complexes,wine and beer shops, eating houses that conduct business in Delhi and transactcash and other precious items, where CCTV Cameras are not installed to coverthe outer areas of such establishments.

            Andwhereas, large number of customers come to these establishments which entailsfinancial transactions.

            Andwhereas, cases of theft, robbery, dacoity, snatching and cheating etc.frequently take place in and around such establishments in Delhi.

            Andwhereas, criminals and anti-social elements have targeted banking and otherfinancial/ commercial establishments leading to loss of life and property.

            Andwhereas, during trial, the Courts give due weight age to the scientificevidence to corroborate oral evidence etc.

            Andwhereas, security and safety is the most important factor for smooth running ofthese banking and financial/business establishments.

            Andwhereas, people visiting these establishments feel unsafe as CCTV cameras arenot installed to cover the outer areas of such establishments.

            Andwhereas, in order to deter criminals and anti-social elements from committingcrime, the installation of CCTV cameras outside such establishments would workas a force multiplier.

            Andwhereas, as per law everybody is bound to inform the police not only about thecommission of certain offences including the offences of robber, dacoity,snatching and cheating etc. but also about the intention to do so.

            Andwhereas, installation of CCTVs to cover the outer periphery would inspirefurther confidence in general public/customers visiting these establishments.

            Andwhereas, installation of such CCTVs would not only help in controlling crimebut also help in flourishing of business, tourism, and overall growth of thesociety.

            Andwhereas, it has been found that most of these establishments have not installedsufficient number of CCTV cameras to cover the critical areas (outerperiphery). It is rendered imperative to put regulatory checks on this issue.

And whereas, it is necessary to takespeedy measures in this behalf to protect property and prevent danger to humanlife and safety, thwart/prevent terrorist activities, which may affect thesecurity of the state and disturb public order and tranquillity.

            Nowtherefore, in exercise of the power conferred upon me by virtue of Section 144Cr.P.C, 1973 (No. 2 of 1974) read with the Govt. of India, Ministry of HomeAffairs, New Delhi’s notification No. U-11036/(i) UTL, dated 09.09.2010, I, DataRam, Assistant Commissioner of Police, Sub-division Kamla Market, CentralDistrict, Delhi, do hereby make this written order for strict compliance bythe owner of all such establishments in the jurisdiction of Sub-division KamlaMarket, Central District, Delhi, who shall within a period of 60 days from thedate of publication of this order.

     I.       Install good quality CCTV cameras in sufficient number andrecording system with play back facility, to cover the area outside suchbanking and financial/business establishments. The CCTV should monitor anyoneentering the premises or loitering outside.

   II.       It should be ensured that the installed CCTV cameras are inworking order all the time in such establishments.

  III.       The recording system shall preserve a digital record of CCTVcoverage for not less than 15 days.

  IV.       The concerned bank and financial/business establishmentsshall cause to copy the CCTV coverage on CD/pen drive and hand over to thepolice whenever required/demanded.

Theseorders shall come into force with effect from 29.05.2015 to 27.07.2015 andshall remain in force for a period of 60 days (both days inclusive) unlesswithdrawn earlier.

All suchbanking and financial/business establishments, like Banks/ATMs, private lockercompanies, jewellery shops, petrol pumps, malls/ restaurants/hotels, cinemahalls/cine complexes, wine and beer shops, eating houses which contravenes thisorder shall be liable for the punishment in accordance with the provisions ofSection 188 of the I.P.C.

            Asthe notice cannot be served individually on all concerned, the order is herebypassed ex-parte. It is being promulgated for the information of the public andlarge and shall be published through the press and by affixing copies on thenotice board of the offices of all Addl. CsP, DCsP, Addl. 2.       And whereas it has come to notice thatcertain criminal anti social elements/terrorists are using these facilities tomislead the security/ investigating agencies, create panic in the public,endanger the security of VVIPs and Govt Institution, help in the terrorists’activities directly affecting the security of the state.

3.       And whereas it is necessary to take speedymeasures in this behalf to prevent danger to human life or safety, tothwart/prevent terrorist activities, which may affect the security of the stateand disturbance of public order and tranquility.

4.       Now, therefore, in exercise of the powersconferred upon me by virtue of section 144 Criminal Procedure Code 1973 readwith Govt. of India, Ministry of Home Affairs, New Delhi’s Notification No U11036/1/2010, (i) UTL, dated 09.09.2010 I,DATA RAM, Assistant Commissioner ofPolice, Sub-Division Kamla Market, Central Distt.  New Delhi dohereby make this written order for strict compliance by the owners of suchCyber Café in the jurisdiction of Sub-Division Kamla Market, Central Distt. Delhi:-

(a)    Prohibiting the use of Cyber Café by unknownperson and whose identity has not been established by the owner of the café ;

(b)   Maintaining a register for establishingidentity of the visitor/user ;

(c)    Make an entry in the handwriting of thevisitor/user mentioning name, address, telephone number and identity proof. Thevisitor/user shall also sign the register kept for this purpose.

(d)   The identity of the visitor/user shall beestablished through identity card, Voter I-Card, Ration Card, driving license,passport or photo credit card( any one of them)

(e)   Activity server log should be preserved inthe main server and its record should be preserved for at least six month.

(f)     If any activity of the visitor is of asuspicious nature, the owner of the cyber café will immediately inform thepolice station.

(g)    Record be maintained about the specificcomputer used by the person.

(h)   Cyber café owners to ensure that the users ofcyber café are photographed on continuous basis and a record of a same ismaintained properly. 

 

5.       This order shall come into force with effectfrom 29.05.2015 and shall remain in force for a period of 60 days up to27.07.2015 (both days inclusive) unless withdrawn earlier.

6.       Any person contravening this order shall beliable to be punished in accordance with the provisions of section 188 of theIndian Penal Code: and

7.        Picketing or Dharnas in any public place with inthe area specified in the schedule and site plan appended to this order withouta written permission.

            And whereas, safety and security ofwomen outside schools/colleges, PG’s hostels etc. is a matter of serious concern.

            And whereas, the unscrupulouspersons loiter around these institutions/hostels/PG’s etc. and installation ofCCTVs in the outer periphery will check unscrupulous activities of suchanti-social elements.

            And whereas, during Court trial,police is required to produce scientific evidence to corroborate oral evidenceetc.

            And whereas, in order to detercriminals and anti-social elements from committing such crime, the installationof CCTV cameras in the outer periphery will work as force multiplier.

            And whereas, installation of CCTV tocover the outer periphery of such institutions/ PG’s/ women hostels etc. wouldinspire further confidence among women community.

            And whereas, installation of CCTVswould help in controlling such crime and augment the safety and security ofwomen.

            And whereas, it is found that mostof these institutions/PG’s/ women hostels etc. have not installed sufficientnumber of CCTV cameras to cover the critical areas (outer periphery), it isrendered imperative to put regulatory checks on this issue.

            And whereas, it is necessary to takespeedy measures in this behalf to prevent crime against women and girlsespecially outside such institutions/PG’s for women (working) & girlstudents and girl hostels etc.

            Now therefore, in exercise of the powerconferred upon me by virtue of Section 144 CrPC 1973 (No. 2 of 1974) read withthe Govt. Of India, Ministry of Home Affairs, New Delhi’s notification no.U-11036/(i) UTL, dated 09.09.2010, I Data Ram, Assistant Commissioner ofPolice, Sub-division Kamla Market, Central District, Delhi, do hereby makethis written order for strict compliance by the owner of all suchestablishments in the jurisdiction of Sub-division Kamla Market CentralDistrict Delhi, who shall within a period of 02 months form the date ofpublication of this order.

I.             Install good quality CCTV cameras in sufficient number andrecording system with play back facility, to cover the area outside suchwomen/girls hostels, institutions, PG’s etc. The CCTV should monitor anyone enteringor loitering outside such premises.

  2. And whereas, a large number of customers come to the Banks and ATMs for day to day transaction, it thus becomes necessary to have quality surveillance on their day to day functioning.
  3. And whereas it has come to notice that certain criminals and anti social elements look for soft targets, particularly during the late evening hours and target employees carrying huge cash/ jewellery items and are vulnerable to crime and criminal, if they are not guarded properly at their business premises and while in transit.
  4. And whereas it is imperative to put some regulatory checks on the activities of such Banks and ATMs so that the anti social and criminal elements do not cause danger to human life and effect loss property.

 

Tosecure premises of Banks by installing CCTVs at their main access, entry in thepremises, inside area and surroundings of the premises. Proper staff shall bedeputed to monitor the CCTV coverage. A video backup of at least 30 days ofsuch recording be kept for further use.

Similarly,ATMs be secured by installing CCTV at their main entry and inside cabin areathrough the video back-up of 30 days. A guard should also be deployed for thesecuring the ATMs.

 

5.     Now therefore, in exercise of the powers conferred upon me by thevirtue of Section 144 CrPC, 1973 (No. 2 of 1974) read with Govt. of India,Ministry of Home Affairs, New Delhi Notification N.U-11036(i) UTL dated09.09.2010, I DATA RAM, AssistantCommissioner of Police, Sub-division Kamla Market, Delhi to hereby makethis written order to all such Banks and ATMs carrying huge transactions ofmoney and jewellery items at their respective branches and their likeestablishments.

6.   These orders shall come in to force with29.05.2015 and shall remain in force for a period of 60 days up to 27.07.2015(both days inclusive) unless withdrawn earlier.

7.   Anyperson/employers/transporter etc. contravening these order shall be liable tobe published in accordance with the provision of Section 188 of the IPC, and

  1. Whereas a large number of complaints are being received that people purchasing liquor from liquor vends often start consuming the same in front of the liquor vend and at other public places.
  2. Whereas it has found that a large number of unauthorized ‘rehris’ and ‘thelewalas’ congregate around liquor vends selling eggs, ‘namkeens’ and ‘bhujia’ etc. Many people buy liquor from liquor vends and start consuming it at these ‘rehris’/’thelas’ & ‘namkeen’ stalls and create a situation whereby it becomes difficult for regular shopper to pass through or visit the area. This affects peace and tranquility of the area and creates problems in maintaining law and order. It is also a punishable offence under section 40 of the Delhi Excise Act-2009.
  3. And whereas it is necessary to take speedy measures in this regard to prevent danger to human life or safety and to thwart/prevent un-toward incidents which may affect the peace and tranquility of the area.
  4. 3.      Andwhereas it has come to notice that certain criminals and anti-social elementslook for soft targets, particularly during the late evening hours and targetemployees carrying huge cash/jewellery items and are vulnerable to crime andcriminal, if they are not guarded properly at their business premises and whilein transit. 

4.      Andwhereas it is imperative to put some regulatory checks on the activities ofsuch NBFC (Non Banking Financial Companies) so that the anti Social andcriminal elements do not cause danger to human life and effect loss ofproperty.

5.     Now,therefore, in exercise of the powers conferred upon me by the virtue of section144 Cr.P.C., 1973 (No.2 of 1974) read with Govt. of India, Ministry of HomeAffairs, New Delhi’s is Notification No. U-11036/(i)UTL, dated 09.09.2010.  I DATA RAM,Assistant Commissioner of Police, Sub-Division Kamla Market, Central District,New Delhi dohereby make this written order that all such NBFC carrying huge transactions ofmoney and jewellery items at their respective offices and their likeestablishments shall :-

A.    Maintainsecure premises by installing CCTVs at their main access, entry in the officeand inside and around the premises. Proper staff shall be deputed to monitorthe CCTV coverage. A video backup of atleast 30 days of such recording be keptfor further use.

B.    Maintaindata base of all employees, security Guards, Cab Drivers and contractualworkers working with them for access by the police as and when required, andensure verification of antecedents of all their employees including contractualemployees.

C.    Theprocedure of ‘KNOW YOUR CUSTOMER’ as issued by the Reserved Bank of India forNationalized Banks be strictly followed and a data base of same shall be keptfor access by the police as and when required.

D.    Theyshall maintain digital record of all the visitors with their photo identity.

E.    Deployarmed security guards at the main entry of such premises and at any othervulnerable point.

F.     Armedsecurity guards must accompany the employees who carry huge cash/gold/jewelleryfrom one place to another. All high values transaction must be done in asecured vehicle which must have CCTV installed.

G.   All suchvehicles being used for transportation of cash or precious metal must be fittedwith GPS for monitoring their movement.

H.   It mustbe ensured that there is no movement of large amount of cash or precious metalafter sunset.

6.      Theseorders shall come into force with effect from 29.05.2015 and shall remain inforce for a period of 60 days up to 27.07.2015 unless withdrawn earlier.

7.     Anyperson/employer/transporter etc. contravening these orders shall be liable tobe punished in accordance with provisions of section 188 of the Indian PenalCode.

1.  And whereas it has been noticed that theprivate courier services generally book goods or items to be transferred on theface value of the courier sender without bothering to verify his or her addressthereby paying the way for unscrupulous persons using the courier services forillegal activities

2. And whereas,instances have come to notice where criminals have used courier services tosent incriminatory items, contraband and even dead bodies in the guise ofcourier.

3. And whereas, ithas also observed that the record of courier sender are not kept by the courierservices or agents engaged in the business of facilitating courier of goodsmaking it difficult for the investigation agencies to identify the culpritsbehind such crimes.

4. And whereas, itis thus rendered imperative to put regulatory check on the private courier servicewho deal in booking and sending goods from one place to another so that theanti social elements may not be able to use them to sent incriminatory thingsthrough them and it is felt that immediate action is necessary in this regard.

5.   2. Keep copies of identification documents like Election Card, Ration Card, PAN Card, Driving License etc. of the courier sender for access by the police as and when required.
  3. Cross check from the concerned company or office if its representative or employee approaches for getting the goods booked for courier in case sender is acting on behalf of a company or office or organization.
  4. Generally satisfy one self about the goods before accepting the packet/parcel for courier.
  5. Install CCTV with sufficient number of cameras and recording system with play back facility, to cover booking office and the area where goods are to be kept. The CCTV should monitor anyone coming for booking a courier.
  6. The recording system shall preserve a digital record of CCTV coverage for not less than 30 days.
  7. The private courier service or agent shall cause to copy the CCTV courage on a CD and hand over to the police whenever demanded.
  8. Inform the nearby police station if the courier sender to the goods is found suspicious.

2.       Andwhereas, it has been noticed that the Second Hand Vehicles are  commonly sold without filling all the columnsespecially date of transaction of Form No. 29 and Form No. 30 (Part –I &II) thereby resulting in transfer of vehicle to number of purchasers before theactual transfer of the vehicle in the records of Transport Authority. This isto circumvent the requirement of section -50 of the Motor Vehicles Act 1988,that the fact of transfer of vehicle should be reported to the TransportAuthority within 14 days for local transfer and 45 days for inter-districttransfer.

3.       Andwhereas, it has been noticed that the stolen vehicles involved in crime aresold to several purchasers through dealers/agents of Second Hand Vehicles. SuchSecond Hand Vehicles are likely to be used for commission of various type ofcrime like robbery etc. and may be used even in terrorist activity.

4.       Andwhereas, it has also been observed that the record of seller and purchaser arenot kept by the dealers or agents engaged in the business of facilitating saleand purchase of Second Hand Vehicles making it difficult for the investigationagencies to identify the criminals involved in such crimes.

5.       Now, therefore, in exercise of the powers conferred  upon me by virtue of Sec 144 Cr.P.C., 1973 ( No-2 of 1974) read with Govt. of India, Ministry of Home Affairs, New Delhi’s Notification No  U-11036 /(i) UTL Dt 09.09.2010, I, DATA RAM, Assistant Commissioner of Police,Sub-Division Kamla Market do hereby make this written order that all suchVehicle dealers who deal in sale and purchase of Second Hand Vehicles includingMotor Cycles, Scooters, and Cars in the jurisdiction of Sub Division KamlaMarket, Delhi shall :-

1.       Whereasa large number of complaints are being received that people purchasing liquorfrom liquor vends often start consuming the same in front of the liquor vendand at other public places. Vendors selling eatables and juices, at time, alsostation themselves unauthorized outside liquor vend which further facilitatesthis undesirable activity. At times, Baratis accompanying Barat also openlydrink liquor etc. on the roads while the Barats are moving. Drinking in publicis a nuisance with serious potential to result in brawl and quarrels causingserious injuries/death and damage to the public and private property. Thisaffects peace and tranquility of the area and creates problems in maintaininglaw and order. It is also a punishable offence under section 40 of the DelhiExcise Act-2009.

2.       Andwhereas it is necessary to take speedy measures in this regard to preventdanger to human life or safety and to thwart/prevent un-toward incidents whichmay affect the peace and tranquility of the area.

3.       Now,therefore, in exercise of the powers conferred upon me by virtue of section 144Criminal Procedure Code 1973 read with Govt. of India, Ministry of Home Affairsand new Delhi’s Notification No U.11036/1/2010, UTL, dated 09.09.2010 I, DATA RAM, Assistant Commissioner of Police,Sub-Division Kamla Market, Central Distt. New Delhido hereby make this written order for strict compliance by the owners ofsuch liquor vends in the area of sub-div Kamla Market, New Delhi.

a) Install CCTV withsufficient number of cameras and recording system to cover up to 50 meters areain front of the shop. The CCTV should monitor anyone consuming liquor orfacilitating consumption of liquor or any unauthorized vender stationed in thecoverage area.

b)  The recording system shall preserve a digitalrecord of CCTV coverage for not less than 10 days.

c)  The vend owner or his agent shall cause tocopy the CCTV coverage on CD  on a dailybasis which shall then be handed over to the Beat Constable of the area againstproper receipt in a register to be maintained at the liquor vend.

d)  Before starting sales for the day, themanager of  the liquor vend should ensurethe CCTV system is in proper working order and in case any defect is noticed,immediate action to get it rectified should be taken. Any entry should be madein the register and intimation in writing should be sent to the police stationsimultaneously to be got duly received front the Duty Officer of the policestation mentioning Daily Diary Number on the intimation. 

e)   During the course of Monitoring of the CCTVsystem, the manager or anyone specifically designated by the Manage for realtime monitoring of the CCTV shall immediately inform the Police Control Room atTelephone No. 100 and also the nearest Police station in case any illegaldrinking in public or unauthorized vendor is noticed in the CCTV coverage area.

f)  The Vend owner shall display prominently atleast two bilingual sign boards mentioning that drinking in public places is anoffence and standing of unauthorized vendors outside the liquor shop isstrictly prohibited. Telephone number of nearest Police Station shall also bementioned on the sign boards.
